Who these terms apply to
These Terms of Service govern your use of infinity-designer.com (the "site") and your relationship with infinity-designer (Via Giuseppe Parini 31, 20862 Arcore (MB), Italy, VAT IT 03847520968) when you request a quote, browse the site, or become a client. If you engage us for a project or retainer, the specific scope, price, timeline and deliverables agreed in your written quote/proposal govern that engagement; where they differ from these general terms, the signed quote/proposal takes precedence for that engagement.
Use of the site
You may browse this site and use the "Request a quote" form to contact us about our services. You agree to provide accurate information in that form and in any related correspondence, and not to use the site for any unlawful purpose.
How an engagement is formed
A quote request is free and non-binding. An engagement (a paid project or retainer) only becomes binding once we’ve confirmed scope and price in writing and you’ve accepted it (by signature, written confirmation, or payment of the agreed deposit) — a form submission alone does not create a contract for paid services.
User obligations
When you engage us, you agree to: provide timely feedback, content and access credentials needed to deliver the work on the agreed timeline; hold the rights to any content, brand assets or materials you supply us for use in the project; and pay invoices by the agreed terms. Intellectual property
- This website. The text, design, layout and code of infinity-designer.com itself are owned by infinity-designer (or licensed to us) and protected by copyright. You may not copy, reproduce or repurpose them without our written permission.
- Client deliverables. For paid engagements, ownership of the final agreed deliverables (design files, source code, brand assets) transfers to you upon full and final payment, as set out in your project’s written quote/proposal. Until final payment is made, we retain ownership of work in progress.
- Third-party components. Some deliverables may include licensed third-party assets (fonts, stock imagery, plugins, platforms such as Shopify or WordPress); those remain subject to their own licence terms, which we disclose where relevant.
Acceptable use
You agree not to: use the site or contact form to transmit spam, malware, or unlawful, defamatory or infringing content; attempt to gain unauthorised access to the site, our systems or other users’ data; scrape or systematically extract content from the site without permission; or interfere with the site’s normal operation (e.g. denial-of-service attempts).
Third-party links
The site may link to third-party sites (e.g. client work, social profiles). We aren’t responsible for the content, availability or privacy practices of sites we don’t control.
Warranties and disclaimers
The site and its published pricing/content are provided in good faith and kept reasonably up to date, but are provided "as is" without warranty of uninterrupted availability or absolute accuracy at every moment. Published "from €X" prices are indicative starting points for a defined scope; your actual project price is confirmed in a written quote before any paid work begins. For engaged projects, we warrant that services will be performed with reasonable skill and care, consistent with professional design/development standards; specific performance warranties (if any) are set out in your project’s written proposal.
Limitation of liability
To the maximum extent permitted by Italian law, infinity-designer’s total liability arising from or in connection with an engagement is limited to the fees paid for that engagement, and we are not liable for indirect, incidental or consequential loss (such as lost profits or lost business opportunity). Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited under Italian law, including liability for death or personal injury caused by negligence, fraud, or mandatory consumer-protection rights.
Governing law and jurisdiction
These terms, and any engagement governed by them, are subject to Italian law. For business clients, the courts of Monza, Italy have exclusive jurisdiction over any dispute. For consumers, this does not deprive you of any mandatory protection afforded by the law of your country of residence, including your right to bring proceedings before the courts of that country under the Italian Consumer Code and applicable EU consumer-protection rules.
Changes to these terms
We may update these terms from time to time to reflect changes to our services or the law. The "last updated" date above reflects the latest revision. Material changes affecting an active engagement will be communicated directly, not just published here.
Severability
If any provision of these terms is found unenforceable, the remaining provisions continue to apply in full.
